Its head office is located at 30, appt 8, rue Moulay Ahmed Loukili, Hassan, Rabat, and specializes in providing individuals and merchants with mobile payment services in accordance with current legislation, via its mobile applications, on the national and international territory.
These general conditions of sale of products/services constitute contractual clauses applicable to any purchase or payment by any user on the application.

These conditions include the following definitions:
Deal: transaction between the customer, owner of the product/service, and the online buyer/user through the intermediation of the service provider who owns the application.
Service provider: Unified Payments, an intermediary, owns the application.
Customer: the supplier who owns the products/services.
Application: the device and mobile platform available on Google Play and App Store and on the website https://www.upay.ma/.
User: Internet user connecting, using the application.
Personal information: information which allows, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies (name, email address, telephone contact details, etc.).
Products/services: all offers made to users by the service provider via its applications.
Online advertising of products/services constitutes an offer to sell by the customer.
The user having placed an order, declares to have read the general conditions of use and declares to have accepted them without reservation. The Deal thus concluded, it is deemed to be a definitive contract between the customer and the user through the service provider.
The order placed by the user constitutes a firm, definitive and irrevocable commitment, subject to confirmation by the service provider of said order.
Payment for products/services resulting from an order is made exclusively on the mobile application.
To pay for your order, you choose the payment method from those offered by UPay on the payment page.

Your multi-channel payments are secured by the Interbank Payment Center (CMI), which offers a fully secure payment service.
The Consumer guarantees to UPay that he has the necessary authorizations to use the payment method chosen by him, when validating the transaction.
In the event of payment by bank card, the provisions relating to fraudulent use of the means of payment provided for in the agreements concluded between the Consumer and the issuer of the card between UPay and its banking establishment apply.
The products are delivered to the address indicated by the consumer on the order form and only in Morocco. The consumer is required to check the condition of the packaging of the goods upon delivery and to report any damage due to the carrier on the delivery note, as well as to UPay and the merchant who shipped the goods, within one week. Regarding shipping, as soon as the merchant / owner of the store or the order has been placed receives your order, he proceeds to send it, you will immediately receive an email and / or notification informing you of this.
The consumer must notify UPay on the day of delivery or at the latest on the first working day following delivery of any claim for delivery errors and/or non-conformity of the products in nature or quality with respect to the information on the order form. Any claim made after this deadline will be rejected.
The consumer has 7 days to return their order, at their own expense, if the product does not suit them. This period begins on the day the consumer's order is delivered. Any return must be reported in advance to UPay Customer Service and to the merchant:
- Priority by telephone from Monday to Friday from 9 a.m. to 12 p.m.,
- By logging into our mobile application in the "track your order" section where, after entering your customer number, you can obtain your order number. The product must be returned by registered mail to UPay Customer Service. Packaged products must not have been unsealed, so that the consumer can benefit from the right of withdrawal. Only products returned in their entirety, in their original packaging, complete and intact, and in perfect condition for resale will be accepted. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged.
Cancellation of the order is always possible as long as your item has not yet been shipped. Your order will then be automatically canceled and you will be immediately refunded by credit to your account if your credit card has already been debited.
Vouchers are personal to the users who placed an order. Users are strictly prohibited from selling these vouchers to others.
The customer assumes liability for any hidden defect or deterioration of the products/services sold under these terms and conditions, and releases the service provider from any legal action against it for any reason whatsoever relating to the sale of the service.
All elements of the application, including texts, logos, photographs and the registered trademark 'UPay', except for documents intended for the public, are the exclusive intellectual property of their owners.
As such, their representations, reproductions, distributions and redistributions, partial or total, without express authorization from the service provider, are prohibited.
We store and process your information on servers protected by technological and human security measures. We ask third parties to verify and certify our privacy principles.
We may share your details with a third party to fulfill your order. We may also use your details to detect potential abuse or fraud, or to send you information about the app or our products.
We may use your personal information for opinions and market research. Your data is then anonymous and will only be used for statistical purposes.
We will not share any of your personal information with third parties without your express consent. Similarly, we do not sell or rent your personal information to third parties for marketing purposes without your express consent.

You can access your main data by logging into your account on the app. You can view your order details, bank details, and any newsletters you may have subscribed to.
You agree to provide accurate information regarding your personal contact details and any other information necessary to access the UPay Services and to regularly update this information if necessary.
The information collected on the application is processed for the purpose of ordering a product, payment, and delivery. The recipients of the data are limited exclusively to those persons authorized to know your data due to their functions. The recipient of the data is the company Unified Payments. The service provider and the client undertake to keep confidential any personal information concerning the user, of whatever nature, to which they may have had access during the conclusion and execution of the service.
This information is deemed confidential and, as such, may not be published or communicated to unauthorized third parties.
Any dispute arising between the parties regarding the conclusion, execution, interpretation, and/or termination of these general conditions of use for any reason whatsoever, which cannot be settled amicably, will be submitted to arbitration.
Any customer who self-refers by registering with multiple and different email addresses and phone numbers will be declared a fraudster and legal action will be taken against them.
